Burial in Cave Hill Cemetery on July 13, 1892. Louisville Courier-Journal Morning Edition, Wednesday July 6, 1892 reports at length on the accidental shooting of William Ochs on July 5 at Sebastian Bott's brewery on 18th Street. The shooter, Max Benz, committed suicide. William Ochs survived until July 12, although the prognosis reported in the article was only a few hours. His death was reported in the morning edition on July 13, 1892 as a news article rather than in death notices or obituaries. 1) From The Louisville Courier-Journal, Wednesday Morning, July 6, 1892, page 6: (Headline) Max Benz's Foolish Deeds. (Headline) Another Trite But Terrible Lesson For People Who Carelessly Handle Fire-Arms. (Headline) The Coroner's Inquest. Max Benz's joke resulted in a horrible tragedy in Seb. Bott's brewery, at Lexington and 18th Streets, at 6:30 o'clock yesterday morning {July 5}. Overcome with grief at mortally wounding William Ochs, Benz committed suicide by shooting himself in the mouth, killing him instantly. Benz was an employe (sic) of the brewery and had just come to work. Ochs was passing by and dropped in. The only witness to the murder was George Rinfeldr, another employe. There was no witness to the suicide. According to Rinfeldr, Ochs was just entering the brewery on his way to work. He was met at the door by Benz, who had just come up out of a cellar and had a revolver in his hand. When Benz met Ochs, Rinfeldr says, Benz said in a good-humored way to Ochs "I am going to shoot you dead," pointing the pistol at him. {line drawing portrait of Wm. Ochs} The pistol was discharged, and Ochs fell to the floor with a groan. The bullet had pierced his brain and he lay unconscious. Rinfeldr immediately notified others at the brewery who were also attracted by the shot. A crowd soon gathered, and Ochs' body was picked up and carried to his home near by. Directly another shot was heard from the second story of the brewery. A number of people ran up the stairs and found Benz lying dead on the floor. From appearances he had rushed upstairs as soon as he saw what he had done and, seating himself on a trunk, loaded the revolver and fired the shot. He placed the muzzle in his mouth and pulled the trigger. The bullet crushed through his head, bringing instant death. Benz's body was conveyed to the morgue of the University of Louisville, where it awaits the Coroner's action. He was a large man and a heavy beer drinker, and by yesterday afternoon the body was in such a condition that it will have to be buried this morning. {Line drawing portrait of Benz) Drs. Holloway, Woody and Smith were immediately summoned to attend to Ochs. His wound is fatal, and death is but a question of a few hours. By strict orders of the physicians no one was allowed in the room. A part of the bullet was recovered, where it had gone through the brain. The other part could not be found. A large piece of the skull was torn away by the shot. Benz came here from Germany six years ago. He was fifty-two years of age, and had lost his family before coming here. He went to work for the Kentucky Malting Company last December, but was discharged from there a couple of weeks ago on account of the fire. Then he went to work at the brewery. He was a quiet, industrious man, and no one about the brewery believes he committed the killing knowingly. They are of the opinion that he thought the revolver was empty and pointed it at Ochs for fun. When he discovered he had shot the man, he was so crazed that he ran to his room over the brewery, loaded the revolver from a box of cartridges in his trunk and took his own life. The appearance of the room would seem to indicate this. Ochs is the son-in-law of Seb Bott, owner of the brewery, and lives at 1613 Eighteenth Street. He is about twenty-seven years of age, and is a tanner and currier by trade. He formerly worked at Phoenix Tanning Company, but , work being slack, he took at position in Diebold's stone works, though he spent much of his time around the brewery. He was married about six years ago to a daughter of Mr. Bott. His wife is prostrate from the shock. Christian Ochs, father of the victim of Benz's shot, does not believe the killing was intentional. He thinks Benz did not know the pistol was loaded, and pointed it at his boy in a spirit of fun. Ochs left home shortly before the tragedy to go to work. Following his usual custom he stopped at the brewery to speak with his father-in-law and others. As he stood near the door of the malting-house Benz came out of the cellar, and smilingly, pointed the pistol at him. The tragedy created a profound sensation in the locality, and in five minutes after it had occurred almost every one in the neighborhood had flocked to the scene. Both men were well known, and Ochs especially so. Though Benz had only lived in the neighborhood a few months he had made many friends. He was a man of gentle disposition and grieved over any injury he had caused others to suffer. Ochs is known and respected by every one in the locality and his mortal wound was regretted by all. Yet there was not one who believed the suicide intended to take his life. Coroner Berry was called, but did not reach the scene until late in the afternoon. He concluded to hold the inquest at the brewery at 10 o'clock this morning.
